These Terms & Conditions ("Terms") govern your access to and use of the sound therapy and wellbeing services provided by Immersive Sound Journeys Pty Ltd (ABN 99 688 354 001), trading as Sound Therapy Australia ("we", "us", "our", "Practitioner"). These Terms apply to all one-on-one sessions, group sessions, workshops, events, in-person services provided in Western Australia, and online services provided globally ("Services").
By booking, attending, or participating in any Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.1 ProviderThe Services are provided by Immersive Sound Journeys Pty Ltd, a company incorporated in Australia and operating from Western Australia, trading as Sound Therapy Australia.
1.2 Nature of ServicesSound therapy is a complementary wellbeing service. It is not a medical, psychological, psychiatric, or allied health service and does not involve the diagnosis, treatment, cure, or prevention of any medical or mental health condition.
1.3 No Healthcare RelationshipParticipation in the Services does not create a doctor–patient, therapist–client, psychologist–client, or other regulated healthcare relationship.
1.4 Scope of PracticeThe Services are offered within the scope of a complementary wellness practice. They do not constitute counselling, psychotherapy, trauma therapy, crisis intervention, or mental health treatment. Clients experiencing acute psychological distress, mental health symptoms, or crisis are advised to seek support from qualified healthcare professionals or emergency services.
2.1 Age RequirementYou confirm that you are at least 18 years of age, or that you have obtained the consent of a parent or legal guardian.
2.2 MinorsClients under 18 years of age must be accompanied by a parent or legal guardian unless otherwise agreed in writing by the Practitioner.
3.1 BookingsSessions must be booked via our website, online booking system, or as otherwise directed by the Practitioner.
3.2 FeesFees are published on our website or booking platform and may change from time to time. The fee applicable at the time of booking will apply.
3.3 PaymentFull payment is required at the time of booking and prior to the commencement of Services unless otherwise agreed in writing. Package-specific terms and expiry conditions will be provided at the time of purchase.
3.4 TaxesAustralian Goods and Services Tax (GST) will be applied where required by law.
4.1 Group ParticipationGroup sessions involve shared spaces and collective experiences. You acknowledge that individual responses to sound therapy may vary and that we are not responsible for the conduct, behaviour, or actions of other participants.
4.2 External or Client-Provided VenuesWhere Services are provided at a venue not owned, leased, or controlled by us, including client premises or third-party locations, you acknowledge that we do not control and are not responsible for the condition, safety, suitability, or accessibility of the venue.
4.3 Venue Safety ResponsibilityThe client, host, or venue provider is responsible for ensuring the space is safe, clean, and appropriate for the Services, including flooring, lighting, temperature, electrical safety, and absence of hazards.
4.4 Limitation of Liability for VenuesTo the maximum extent permitted by law, we are not liable for any injury, loss, or damage arising from venue conditions or circumstances outside our reasonable control.
All appointments are prepaid in full at the time of booking. Your booking reserves time held exclusively for you and includes preparation prior to your session.
5.1 ReschedulingAppointments may be rescheduled with a minimum of 48 hours’ notice prior to the scheduled appointment time, subject to availability.
Rescheduling requests made with less than 48 hours’ notice cannot be accommodated and the session fee will be forfeited.
5.2 Cancellations & No-Shows• Cancellations made more than 48 hours before the appointment are eligible for rescheduling only• Cancellations made within 48 hours of the appointment time, or failure to attend your appointment (no-show), will result in forfeiture of the full session fee• No refunds are provided for change-of-mind cancellations or missed appointments
5.3 RefundsPrepaid appointment fees are non-refundable for change of mind.
Refunds will only be provided where required under the Australian Consumer Law, including where a service is not delivered or fails to meet consumer guarantees.
5.4 Exceptional CircumstancesIn the event of a genuine emergency, please contact us as soon as possible. Any exceptions to this policy are applied at our sole discretion.
6.1 Client EnvironmentYou are responsible for ensuring a safe, private, and appropriate physical environment when participating in online Services.
6.2 Technology LimitationsWe are not responsible for interruptions, delays, or reduced quality of Services caused by internet connectivity issues, device malfunction, or third-party platforms beyond our control.
6.3 RecordingSessions must not be recorded, photographed, or reproduced in any form without prior written consent.
7.1 Client Disclosure ObligationYou acknowledge that you are solely responsible for disclosing, prior to participation and on an ongoing basis, any medical, physical, psychological, neurological, emotional, or other health-related condition, diagnosis, medication, pregnancy, injury, trauma history, sensory sensitivity, or circumstance that may affect your participation or safety. Failure to disclose relevant information releases the Practitioner from liability to the extent permitted by law.
7.2 Complementary Nature of ServicesSound therapy is not a replacement for medical, psychological, psychiatric, or allied health care. The Services do not diagnose, treat, cure, or prevent any condition and are not intended to replace professional healthcare, medication, counselling, or rehabilitation services.
7.3 No Guaranteed OutcomesResponses to sound therapy vary between individuals. Experiences may be subtle, gradual, or different from expectations. No specific outcomes, results, or benefits are guaranteed.
7.4 Voluntary Participation & AutonomyParticipation is voluntary. You may pause or discontinue a session at any time and agree to notify the Practitioner if discomfort, distress, or concern arises.
7.5 Adverse ResponsesWhile sound therapy is generally gentle, emotional or physical sensations may occur. You agree to immediately inform the Practitioner of any discomfort, distress, or adverse response.
7.6 No Emergency or Crisis ServicesThe Services are not suitable for emergency or crisis care. You agree to seek immediate assistance from emergency services or qualified healthcare providers where required.
7.7 Practitioner DiscretionThe Practitioner reserves the right to modify, pause, or cease a session where there are concerns regarding client safety, wellbeing, or appropriate scope of practice. No refunds are payable where a session is ceased for safety or ethical reasons.
8.1 Acknowledged RisksYou acknowledge that participation in sound therapy and relaxation-based practices involves inherent and foreseeable risks, including but not limited to emotional release, physical sensations, dizziness, fatigue, discomfort, or psychological responses.
8.2 Voluntary AcceptanceBy participating in the Services, you voluntarily accept these risks and choose to proceed with full knowledge of the nature of the Services, except where liability cannot be excluded by law.
9.1 PrivacyPersonal information is handled in accordance with our Privacy Policy and applicable Australian privacy legislation.
9.2 DisclosureInformation may be disclosed where required by law, to prevent serious harm, or with your consent.
10.1 OwnershipAll materials, session content, recordings (if any), written communications, website content, and intellectual property remain the property of Immersive Sound Journeys Pty Ltd.
10.2 RestrictionsYou may not reproduce, distribute, share, or commercialise any content without prior written consent.
11.1 ACL Rights PreservedNothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law that cannot be lawfully excluded.
11.2 Limitation of LiabilityTo the maximum extent permitted by law, we exclude liability for any indirect, incidental, special, or consequential loss arising from or connected with participation in the Services.
11.3 Third-Party Platforms & VenuesWe are not responsible for the actions, omissions, failures, or conditions of third-party platforms, venues, hosts, or service providers.
11.4 IndemnityTo the extent permitted by law, you agree to indemnify Immersive Sound Journeys Pty Ltd against any loss, damage, liability, or expense arising from your breach of these Terms or failure to disclose relevant health information.
11.5 Conduct & Right to Refuse ServiceWe reserve the right to refuse, suspend, or terminate Services where a client engages in inappropriate, unsafe, abusive, or disrespectful behaviour, or where continued provision of Services would exceed our professional or ethical boundaries. In such cases, no refund is payable.
We are not liable for any failure or delay in providing Services due to events beyond our reasonable control, including illness, natural disasters, power outages, venue closures, or government restrictions.
13.1 Applicable LawThese Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
13.2 JurisdictionYou submit to the exclusive jurisdiction of the courts of Western Australia to the extent permitted by law.
We may update these Terms from time to time. Continued use of the Services after updated Terms are published constitutes acceptance of the revised Terms.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
